Rochester billionaire Tom Golisano appeared in Ontario County Court Sept. 27 to challenge the assessment on his former Victor home; however, there was no decision made Thursday.

According to Golisano’s lawyer Glenn Pezzulo, Golisano is seeking $197,256.28 that he said he is owed because the house was over-assessed.

The property involved in the lawsuit is at 1648 Malone Road in Victor. It includes two parcels — a 16-acre one where the house stands, and a 20-acre vacant lot. The property sold for slightly over $1.3 million on Feb. 23 to Susan Gravino. The 2011-12 assessed value was $2.329 million, Pezzulo said.
Golisano challenged the last four years of assessments, yet he has still had to pay taxes each year, his lawyer added.

The assessment on the property has continued to decrease from 2007. According to Pezzulo’s figures, it was assessed at $3.479 million in 2008-09, $3.219 million in 2009-10, and $2.829 million in 2010-11.

The Victor home was originally intended to be for Golisano’s daughter, but after awhile it became apparent that she would be unable to pay the property taxes, the billionaire said in court. The Malone Road property went on the market April 1, 2007.

The mansion includes a four-car garage, and a four-car carriage barn designed to be able to work on race cars. It also has a large swimming pool, and 12 bedrooms.

With a recession hitting the country soon after the property went on the market, Golisano had trouble selling the property.

“Anything above $1.3 million I would have accepted in a minute,” Golisano said.

The Town of Victor was represented by Sheila Chalifoux, who denied Golisano’s claims.
“They say the town (of Victor) grossly over-assessed the property; that’s just not true,” she said.

The case was before Judge Frederick Reed.

This isn’t the first time Golisano has challenged an assessment. In 2010, the Paychex founder fought against the assessment of his house in Mendon. It was originally assessed at more than $6 million, and Golisano got the value cut in half.

The trial was scheduled to continue Friday.
